Welcome to the Discovery Kids mobile app (the “App”)!

This App is operated and provided to you by DPlay Entertainment Limited, registered in England with company number 09615785 whose registered office is at Chiswick Park Building 2, 566 Chiswick High Road, London, W4 5YB, United Kingdom (“DEL”, “we”, “us, “our”).

By installing and using the App, you confirm that you are 18 years old or over. Minors may use the App with your permission and under your supervision.

Please read these terms (the “Terms of Use”) before installing and using the App. They set out the agreement for your (and your household’s) access to and use of the App. By installing and subsequently using the App you agree, and agree on behalf of your household, to these Terms of Use. If you don’t agree to them, please don’t use the App. If you have any questions about the Terms of Use, please contact us using any of the contact methods in the ‘Contacting us’ section below.

  1. Access to the App
    1. By downloading and installing the App, you will be able to access and view content, which may include videos, games, books, music, graphics, text, images, photographs and illustrations (“Discovery Kids Content”), on the terms and conditions set out in these Terms of Use.
    2. You may be able to access and view some Discovery Kids Content for free, but some Discovery Kids Content may only be available to you if you purchase a subscription through DEL or a third party (“Discovery Kids Subscription”).
    3. You can view details of your Discovery Kids Subscription, in the Account Settings area in the App.
    4. We may require you to register a Discovery Kids account (“Discovery Kids Account”) by providing your details or by using an account you already hold with a third party platform, such as Facebook. To register a Discovery Kids Account and purchase a Discovery Kids Subscription you must be aged 18 years or older.
    5. When you sign up for a Discovery Kids Account or purchase a Discovery Kids Subscription you are responsible for all access to and use of the App by you and your household.
    6. You are also responsible for your Discovery Kids Account username and password, for keeping them confidential, and for all activities that are carried out under them. We recommend that you do not reveal your payment details, username and password to any other person. You agree to notify us immediately if you become aware of or suspect any unauthorised use of your password or username.
  2. Free trial
    1. Your Discovery Kids Subscription may start with a free trial period. Free trials are available to new subscribers only (one per household), unless we tell you otherwise, and are subject to availability. The specific duration of the free trial will be specified at the point of sign-up.
    2. You will be charged the total subscription fee due for the next subscription period at the end of your free trial period, unless you cancel your Discovery Kids Subscription at least 24 hours before the expiry of the free trial. Please note that you may not be notified that your free trial is ending or has ended and that your paid subscription has started. You agree that you will be solely responsible for monitoring when your free trial is ending and when your paid subscription is starting. When subscribing via a third party, for example an app-store or via one of our partners, please also see section 9 below.
    3. You agree not to register multiple times for the same type of promotional offer using multiple names, addresses, email addresses or other means. Any such action shall be a breach of these Terms of Use and may result in the termination of your Discovery Kids Subscription.
  3. Promotional Offers
    1. DEL, or our third party partners, may make available vouchers or other promotional offers which grant access to a Discovery Kids Subscription for a certain period for free or at a discount, including offers provided as part of a bundle with the products or services of one of our partners (“Promotional Offers”). Promotional Offers may be used and redeemed in accordance with the specific terms and conditions which relate to such offers.
    2. Promotional Offers are available to new subscribers only (one per household), unless stated otherwise, and are subject to availability in your territory. Where a Promotional Offer is combined with a free trial, restrictions may apply. You will need to check the relevant terms and conditions of the Promotional Offer for full details. Where a Promotional Offer is provided by a third party, additional terms and conditions may also apply.
  4. Billing
    1. You will be charged for your Discovery Kids Subscription using the payment method provided when you first subscribe or set up your Discovery Kids Account. Subscription payments will be taken automatically on the first day of each new subscription period for your Discovery Kids Subscription. Usually the first payment will be taken on the day after any free trial period ends.
    2. If you are eligible for a Promotional Offer involving a discount your bill and payments will be reduced accordingly for the promotion period.
    3. To view your billing information or to change your payment method, go to the Account Settings area in the App (unless you’re paying via a third party, for example an app-store or via one of our partners, in which case see section 9 below).
    4. If a payment is not successfully settled, because your payment method has expired, you have insufficient funds, or otherwise, and you do not change your payment method or cancel your Discovery Kids Subscription, we may suspend your access to your Discovery Kids Subscription until we have obtained a valid payment method. When you update your payment method, you authorise us to charge the updated payment method for your Discovery Kids Subscription and you remain responsible for any uncollected amounts. This may result in a change to your payment dates or subscription period.
    5. We reserve the right to change the date we charge you if your payment method has not been successfully authorised or if that renewal date does not occur in a given month.
    6. For some payment methods, the relevant issuer may charge you certain fees, such as a foreign transaction fee or other fees relating to the processing of your payment method. Local taxes and charges may vary depending on the payment method used. Check with your payment provider for details.
  5. Automatic renewal
    1. Certain types of Discovery Kids Subscriptions automatically renew unless you cancel your subscription at least 24 hours before your next renewal date.  We will let you know, at the point of sign-up, if your type of Discovery Kids Subscription will automatically renew. If you have a Discovery Kids Subscription which automatically renews, and you do not cancel your subscription at least 24 hours before the end of the current subscription period (or free trial period), your Discovery Kids Subscription will automatically renew. If your Discovery Kids Subscription automatically renews, you will be charged the total subscription fee due for the next subscription period. You agree that you are responsible for monitoring and managing the automatic renewal of your Discovery Kids Subscription in accordance with these Terms of Use and any applicable third party terms and conditions.
    2. If you signed up for a Discovery Kids Subscription through a third party (for example, an app-store or via one of our partners) and wish to check your automatic renewal status, you will need to do so through that third party and subject to that third party’s applicable terms and conditions. For example, you may need to visit your account with a third party app-store and turn off auto-renew for the App.
    3. If you have redeemed a Promotional Offer and wish to check the automatic renewal status of your Discovery Kids Subscription, you will need to refer to the specific terms and conditions which relate to that Promotional Offer.
  6. Price changes
    1. We may change the price of your Discovery Kids Subscription from time to time. Any price changes will apply to you no earlier than 30 days following notice to you. If you have purchased a Discovery Kids Subscription through one of our third party partners, price changes will be subject to that third party’s terms and conditions.
    2. If we notify you of a price change and you do not want to continue your Discovery Kids Subscription at the new subscription price, you can cancel your Discovery Kids Subscription either: (i) before the start of the next subscription period by following the steps in section 7 (Cancellation) below; or (ii) at any time before the price change becomes effective by providing us with notice at the details set out in section 23 below.
  7. Cancellation
    1. You can cancel your Discovery Kids Subscription at least 24 hours before the end of the current subscription period (or free trial period) and the cancellation will be effective at the end of the current subscription period (or free trial period). This means that if you are part of the way through a subscription period, you will be able to continue to use your Discovery Kids Subscription until the end of the current subscription period.
    2. When you purchase a Discovery Kids Subscription you agree: (a) we will provide you with access to your Discovery Kids Subscription immediately; and (b) you waive your statutory right to: (i) change your mind about your Discovery Kids Subscription; and (ii) receive a refund within the applicable cooling off period.
    3. To manage your Discovery Kids Subscription, click on the Account Settings area in the App.
    4. If you signed up for a Discovery Kids Subscription through a third party (for example, an app-store or via one of our partners) and wish to cancel or otherwise manage your Discovery Kids Subscription, you will need to do so through that third party and subject to that third party’s terms and conditions. For example, you may need to visit your account with a third party app-store and turn off auto-renew for this App.
  8. Refunds and credits
    1. Without affecting your statutory rights (other than as set out in section 7.2 above), payments are non-refundable and there are no refunds or credits for partially used billing periods. At any time, and for any reason, we may provide a refund, discount, or other consideration to some or all of our subscribers. If we do this for any reason this does not mean we are obligated to do so again, even in the same circumstances.
    2. If you signed up for a Discovery Kids Subscription through a third party (for example, an app-store or via one of our partners) and encounter any problems with billing or payments, please contact that third party in respect of any refunds or credits relating to your Discovery Kids Subscription in accordance with that third party’s terms.  For any other issues relating to your Discovery Kids Subscription, you can contact us using the details at the end of these Terms of Use.
  9. Third party platforms and services
    1. If you access the App or purchase a Discovery Kids Subscription through a third party (for example, via an app-store or via a bundle of services provided by one of our third party partners), your payment will be to that third party and you will be subject to that third party’s terms (including any applicable usage rules). Important information on the applicable terms of sale, charges, taxes, payment methods, free trial periods and any applicable Promotional Offers (including information on how much is charged and when, the exact duration of the free trial period or Promotional Offer, and what happens when the free trial period or Promotional Offer ends), automatic renewals, refunds and credits, your right to cancel a transaction and when you can exercise such right (where applicable), and the technical steps to conclude a transaction, will be detailed in the third party’s terms and conditions. However, you must also comply with these Terms of Use.
    2. If you are paying for a Discovery Kids Subscription via a third party and your access to your Discovery Kids Subscription is suspended at any time, for any reason (including a payment not being successfully settled), you should first contact the third party through which you purchased your Discovery Kids Subscription.
    3. If you are paying for a Discovery Kids Subscription via a third party and you wish to change your payment method, you will need to do so through that third party.
    4. As set out in section 5 above, if you signed up for a Discovery Kids Subscription through a third party (for example an app-store or via one of our partners) and wish to cancel your subscription, you will need to do so through that third party. For example, you may need to visit your account with a third party app-store and turn off auto-renew for the App.
  10. Supported devices and updates
    1. Availability of the App, your Discovery Kids Subscription and Discovery Kids Content depends on the quality of your internet connection and device capabilities. Some features may not be available on all devices. Please visit the FAQs to see the full list of supported devices and operating system requirements.
    2. To get the best Discovery Kids experience, we recommend that you accept any updates to the App as and when they become available. This may also require you to update your device operating system.
    3. Your use of any updates, modifications to, or replacement versions of the App will be governed by these Terms of Use and any additional terms you agree to when you install such update, modification, or replacement version.
  11. Device restrictions
    1. You and your household can use your Discovery Kids Account to access your Discovery Kids Subscription from a maximum of 5 devices.
    2. Subject to the terms and conditions of any applicable Promotional Offer, you may access your Discovery Kids Subscription through your Discovery Kids Account at the same time on up to 2 devices within your household.
  12. Your data usage
    1. You are responsible for all internet access, mobile data or other charges incurred when using the App and your Discovery Kids Subscription. Remember that streaming and downloading audio-visual content such as videos and games can use up a lot of data.
  13. Changes to Discovery Kids
    1. DEL may regularly make changes to any element of the App, your Discovery Kids Subscription or the Discovery Kids Content. In particular, the availability of Discovery Kids Content may change from time to time (for various reasons, such as where relevant third party rights-holders withdraw or restrict our right to use that content on the App). We therefore have the right to add or withdraw Discovery Kids Content at any time, with or without notice. You acknowledge and agree that the Discovery Kids Content is variable and will change from time to time without notice. There may also be times when DEL has to remove certain features or functionality and/or stop allowing certain devices or platforms from being able to access the App. We may also update or upgrade the App from time to time.
    2. If changes to the App are likely to materially adversely affect the App we will try to make sure that any changes will not adversely affect you during your current subscription period so you have the chance to cancel your Discovery Kids Subscription before the next subscription period begins by following the steps in section 7 (Cancellation) or in section 9 (Third party platforms and services) above. If we have to make a materially adverse change to the App during your Discovery Kids Subscription, we will give you 30 days’ notice and the right to cancel. If you do not cancel your Discovery Kids Subscription after we have notified you about any changes and before these changes take place, and you continue to use the App, we will take that as your acceptance of the changes.
  14. Ownership
    1. All Discovery Kids Content is protected by copyright, trademark, and/or other proprietary intellectual property rights owned by or licensed to us.
    2. You have no intellectual property rights in, or to, the App, the Discovery Kids Subscription or the Discovery Kids Content other than the right to use them in accordance with these Terms of Use.
    3. You may not remove, alter or in any way tamper with any copyright notices or other proprietary markings included in the App or any Discovery Kids Content. Any copying, access, transfer, public performance or communication to the public or other use of the App, the Discovery Kids Content or the Discovery Kids Subscription other than as expressly authorised by your local law or these Terms of Use shall constitute an infringement of applicable intellectual property rights and a breach of these Terms of Use. In the event of such infringement, we, or one of our affiliated companies, may, without notice or prior intervention of a court or arbitral body, block your access to the App and terminate any Discovery Kids Account you may have and pursue any rights or remedies available to us.
  15. Your use of the App
    1. You confirm that: (a) any information and details provided by you to us, including on registration of a Discovery Kids Account, are true, accurate and up to date in all respects and at all times; (b) you will at all times comply with these Terms of Use; and (c) you will not use the App for any unlawful purpose or in a way which infringes the rights of anyone else.
    2. You must use the App in accordance with all applicable laws, rules and regulations, and any other restrictions on your use of the App, the Discovery Kids Subscription or the Discovery Kids Content.
    3. You must not transmit any material that is defamatory, offensive or otherwise objectionable in relation to your use of the App, the Discovery Kids Subscription or the Discovery Kids Content.
    4. The App, the Discovery Kids Subscription and the Discovery Kids Content are licensed to you (not sold) for your personal and non-commercial use only. While you and your household are using the App, we grant you a limited, non-exclusive, non-transferable, licence to access the Discovery Kids Content and stream, download, temporarily store and view the Discovery Kids Content. Except for the limited licence granted to you in these Terms of Use, no right, title or interest in the App, the Discovery Kids Subscription or the Discovery Kids Content shall be transferred to you. You must not reproduce, perform, display or exhibit the App, the Discovery Kids Subscription or the Discovery Kids Content in any public place.
    5. Use outside your home country of residence:
      1. Non EU Residents: If you are not an EU resident, the App, the Discovery Kids Subscription and the Discovery Kids Content (or any part of them) may not be accessible outside of your home country of residence. If you try to access the App, the Discovery Kids Subscription or the Discovery Kids Content in another country, you may not be able to play certain Discovery Kids Content while you are in that country.
      2. EU Residents: If you are an EU resident, you can access your Discovery Kids Subscription when visiting another EU country, at no extra cost. This means that you can enjoy the same service abroad that you would at home; you will be accessing the same programs, in the same language. This access is available only if you are temporarily abroad in another EU country and we were able to verify that your country of residence is in the EU.

    6. You (and your household) must not, and must not allow third parties to: (a) access, view and/or purchase the Discovery Kids Subscription or Discovery Kids Content using a virtual proxy network; (b) display, perform, publish, license, offer for sale, make and/or distribute copies of the App, the Discovery Kids Subscription or the Discovery Kids Content; (c) attempt to copy, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange or translate the App, the Discovery Kids Subscription or the Discovery Kids Content except as permitted by applicable law; (d) create derivative works of the App, the Discovery Kids Subscription or the Discovery Kids Content of any kind whatsoever; or (e) circumvent, remove, alter, deactivate, degrade or thwart any of the content protections in the App or the Discovery Kids Content.
  16. Privacy
    1. Any personal information you supply to us or that we collect from you when using the App, your Discovery Kids Account, or your Discovery Kids Subscription will be used by us in the ways set out in our Privacy Policy. Please also ensure you read our Cookie Policy
  17. Ending your right to use Discovery Kids
    1. We may end your right to use all or any part of the App or your Discovery Kids Subscription immediately if we have a reasonable belief that you have breached these Terms of Use or if you are using the App, the Discovery Kids Content or your Discovery Kids Subscription in any manner other than for its intended purpose or illegally. If what you have done can be put right we may give you a reasonable opportunity to do so.
    2. If we decide to discontinue the App, we will give you at least 30 days’ prior notice. In no event will we be liable in any way for the discontinuation of the App, the removal of or disabling of access to the App or for the withdrawal of the service or any Discovery Kids Content.
    3. If we end your rights to use the App or your Discovery Kids Subscription you must stop all activities authorised by these Terms of Use, including your use of the App or your Discovery Kids Subscription.
  18. Our liability to you
    1. We accept liability for death or personal injury caused by our negligence or that of our employees and agents. We do not seek to exclude liability for fraudulent misrepresentation by us or our employees or agents.
    2. If we breach these Terms of Use we will only be liable for losses which are a reasonably foreseeable consequence of that breach. Losses are foreseeable where they could be contemplated by you and us at the time of you agreeing to these Terms of Use.
    3. We are not responsible for:
      1. any use of the App or Discovery Kids Content which isn’t authorised by us;
      2. any malfunction or interruption to the App or Discovery Kids Content due to unforeseeable circumstances that prevent us from fulfilling our obligations to you;
      3. errors, viruses or bugs present in or arising from your use of the App or Discovery Kids Content;
      4. incompatibility of the App or Discovery Kids Content with any other software or hardware (including any of your devices); and
      5. any act or default of any third party platform, service provider, supplier, device manufacturer or provider of a device operating system, which are beyond our reasonable control.
    4. You have certain statutory rights under the applicable laws of your territory. Nothing in these Terms of Use is intended to affect these statutory rights. For more information about your statutory rights contact your local consumer organisation.
    5. Apart from liability arising in respect of the circumstances set out in section 18.1 (which is unlimited), to the fullest extent permitted under local law, in no event shall our total liability to you for all damages arising from your use of the App or the Discovery Kids Content or your Discovery Kids Subscription, exceed the amount you have paid for your Discovery Kids Subscription.
    6. We can’t guarantee that the App or the Discovery Kids Content will be free from bugs or errors or that your access will be free from interruptions (for example there may be downtime for maintenance or updates or any power or server outages or other reasons outside our control), however where we are made aware of technical issues then we will always try to fix them.
    7. Please note that we are not responsible for any lack of functionality or failure to provide any part of the App or the Discovery Kids Content, or any loss of content or data that is due to: your equipment, devices, operating system or internet connection, your failure to download the most recent published version of the App or meet the compatibility requirements or the consequences of you changing your equipment, device, operating system or internet connection.
  19. Changes to these Terms of Use
    1. We may, from time to time, change these Terms of Use.
    2. We will aim to notify you at least 30 days before making any material changes to these Terms of Use, unless the changes need to be implemented quickly for security, legal or regulatory reasons in which case we will notify you of the changes as soon as we can.
    3. If any change to these Terms of Use will materially disadvantage you, or materially impact the availability of the App, we will provide you with 30 days’ notice before the changes become effective and you can choose to cancel your Discovery Kids Subscription before the changes become effective (see section 7).
    4. You are responsible for keeping up to date with any changes to the Terms of Use from time to time. If you continue to use the App following any change to these Terms of Use, we will take this as your acceptance of the amended Terms of Use. The most up to date Terms of Use will always be available on the App.
  20. Transfer of rights
    1. The agreement between us and you is personal to you and no third party (other than your household) is entitled to benefit under it. You agree we can transfer our rights and obligations under these Terms of Use to any company, firm or person provided that your Discovery Kids Subscription will not be adversely affected as a result of such transfer. You may not transfer your rights or obligations under these Terms of Use to anyone else.
  21. Governing law
    1. These Terms of Use shall be governed by and construed in accordance with the laws of England and Wales. However, these terms will not limit any consumer protection rights that you may be entitled to under the mandatory laws of your country of residence. If you do not live in England or Wales, you will be able to bring a claim in the courts of your country of residence.
  22. Complaints
    1. If you have any complaint please speak to us first, by contacting us using the details below. In addition, please note that if you live in a European Union member state, or in Norway, Iceland or Lichtenstein, disputes may be submitted for online resolution to the European Commission Online Dispute Resolution (“ODR”) platform available at https://ec.europa.eu/consumers/odr. We do not currently use alternative dispute resolution (“ADR”), including through the ODR platform, as a means of settling consumer complaints.
  23. Communications
    1. We will send you information relating to your Discovery Kids Account and (where applicable) your Discovery Kids Subscription (e.g. payment authorizations, invoices, changes in password or payment method, confirmation messages, content and feature updates and other service or transactional messages) by in-app message or email to the email address provided during sign up (if you signed up via a third party, for example via an app-store or one of our third party partners, or used your account details with a platform such as Facebook, then we may obtain your email from that third party so that we can keep you up to date with service-related messages).
